Agreement Between User and Treasure It

Welcome to treasureit.fun. The treasureit.fun website (the "Site") and mobile application (collectively, the "Site") is comprised of various web pages and mobile interfaces operated by Treasure It LLC ("Treasure It"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. If you do not agree to these Terms, then do not access or use the Site.

Treasureit.fun is a Marketplace Site that connects neighbors to buy and sell or give and receive items or services. The Site is used at the user's own risk. Users of the Site who buy, sell, give, or receive items or services through the Site do so directly between themselves. Treasure It is not a party to any exchange between users and is not responsible for any aspect of such exchanges. This includes the condition, safety, legality, or quality of items, the conduct of users, and the arrangement and completion of any pickup or delivery.

Users must abide by the community guidelines and Treasure It policies at all times. This includes, but is not limited to, agreeing that the Site shall not be used to give or ask for any illegal items, counterfeits, weapons, drugs, alcohol, animals, or tickets. Hate speech, harassment, or threats are also not tolerated.

Privacy

Your use of the Site is subject to Treasure It's Privacy Policy. By using the Site, you consent to the data practices described in the Privacy Policy. Please review our Privacy Policy, available at https://treasureit.fun/copy-of-privacy-policy, which also governs the Site and informs users of our data collection practices.

You further acknowledge and agree that Treasure It may preserve or disclose your User Content, as well as your personally identifiable information, such as email addresses, IP addresses, timestamps, and other user information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce these Terms; respond to claims that any User Content violates the rights of third-parties; or protect the rights, property, or personal safety of Treasure It, its users, or the general public.

Electronic Communications

Visiting the Site or sending emails to Treasure It constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or phone, and you agree to accept responsibility for all activities that occur under your account or password. You must provide accurate and complete account information and use your true identity in your account and in all communications with other users on the Site, and promptly update this information if it changes. You may not assign or otherwise transfer your account to any other person or entity. If you discover or suspect that someone has accessed your account without your permission, you must notify Treasure It promptly. You acknowledge that Treasure It is not responsible for third party access to your account that results from theft or misappropriation of your account. Treasure It and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. We additionally reserve the right to reclaim Treasure It account usernames, including where a username infringes or may infringe the trademark or other intellectual property rights of any other person or entity.

Use by Minors

In compliance with the Children's Online Privacy Protection Act ("COPPA"), Treasure It does not knowingly collect, either online or offline, personal information from persons under the age of 13. If we become aware that we have collected personal information from a child under the age of 13, we will delete that user's account, and any information associated with that account as quickly as possible. If you are under the age of 18, you may use the Site only with permission of a parent or guardian. By accessing or using any part of the Site, you represent that you meet the age requirements set forth in this section.

Links to Third Party Sites/Third Party Services

The Site may contain links to certain services that are offered by third-party service providers, including through links to third-party sites, video, email, telephone communication, and/or other offers outside of the Treasure It platform ("Third Party Services"). The Third Party Services are not under the control of Treasure It, and Treasure It is not responsible for the contents of any Third Party Service, including without limitation any link contained in a Third Party Service, or any changes or updates to a Third Party Service. Treasure It makes no representations or warranties regarding any Third Party Services, including their accuracy, completeness, or usefulness for any purpose. Treasure It is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Treasure It of the site or any association with its operators. Your access to and use of any Third Party Service is at your own risk. The terms of this Agreement and the Treasure It Privacy Policy do not apply to your use of any such Third Party Services.

Certain services made available via the Site are delivered by third party sites and organizations. Your dealings or correspondence with any Third Party Services including any terms, conditions, representations, or warranties associated with such dealings, are solely between you and the third party. By using any product, service or functionality originating from the treasureit.fun domain, you hereby acknowledge and consent that Treasure It may share such information and data with third-party service providers with whom Treasure It has a contractual relationship solely to provide the requested product, service or functionality on behalf of treasureit.fun users and customers, and only to the extent necessary for that purpose.

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Treasure It that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you agree not to engage in any conduct that is unlawful, misleading, fraudulent, or discriminatory on the Site (or to facilitate or support others in doing so). You may not use the Site to do or share anything that infringes or violates someone else's rights, including their intellectual property rights (such as by infringing another's copyright or trademark, or distributing or selling counterfeit or pirated goods), unless an exception or limitation applies under applicable law. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Treasure It or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Treasure It content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Treasure It and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Treasure It or our licensors except as expressly authorized by these Terms.

By posting, uploading, or otherwise submitting any content, photos, text, or other materials ("User Content") to the Site, you hereby grant Treasure It a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, reproduce, modify, adapt, publish, distribute, publicly perform or display, and create derivative works of your User Content in connection with the operation of the Site and its services. This license will end when your content is deleted from our systems, except that copies of content that have already been shared with or sublicensed to third parties prior to deletion may continue to be used by those parties in accordance with the terms under which such content was shared.

You represent and warrant that you own or have all rights necessary to grant this license, that your User Content does not infringe the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party, and that your User Content complies with these Terms and all applicable laws.

If you believe that content appearing on the Site infringes your copyright or other intellectual property rights, please provide Treasure It's designated agent with each of the following:

• a) Identification of the copyrighted work you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
• b) Identification of the material on the Site that you claim is infringing, with enough detail so that we may locate it, including the relevant URL or page location;
• c) A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• d) A statement declaring under penalty of perjury that (1) the above information in your notice is accurate, and (2) that you are the owner of the copyright or intellectual property interest involved, or are authorized to act on behalf of that owner;
• e) Your address, telephone number, and email address; and
• f) Your physical or electronic signature.

Your notice will be subject to the Digital Millennium Copyright Act (DMCA). In accordance with the DMCA and other applicable law, Treasure It has adopted a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the intellectual property rights of others. Treasure It reserves the right to remove content alleged to be infringing without liability to you. Notifications may be sent to ben@treasureit.fun.

Use of Communication Services

The Site may contain bulletin board services, chat areas, direct messages, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

By way of example, and not as a limitation, you agree that when using a Communication Service, you will not: defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others; publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, fraudulent, misleading, or unlawful topic, name, material or information; post or share content that promotes violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; post or share content containing private information of any third party, including addresses, phone numbers, or payment card information, without that party's consent; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents; upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages; conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner; falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded; restrict or inhibit any other user from using and enjoying the Communication Services; violate any code of conduct or other guidelines which may be applicable for any particular Communication Service; harvest or otherwise collect information about others, including e-mail addresses, without their consent; attempt to obtain the password, account, or other security information of any other user; crawl, scrape, or spider any page, data, or portion of the Site or its content; send any form of auto-responder, spam, or unsolicited automated communications through any Communication Service; or violate any applicable laws or regulations.

Treasure It has no obligation to monitor the Communication Services. However, Treasure It reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Treasure It reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Treasure It reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Treasure It's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. While most users of the Site are trustworthy, there are always risks involved with transacting with strangers. Treasure It does not control or endorse the content, messages or information found in any Communication Service and, therefore, Treasure It specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Treasure It spokespersons, and their views do not necessarily reflect those of Treasure It.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

Third Party Accounts

You will be able to connect your Treasure It account to your third party accounts. By connecting your Treasure It account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). You are ultimately in control of how much information is accessible to us and may exercise such control by adjusting your privacy settings on your Third Party Account. If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by Treasure It from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Treasure It Content accessed through treasureit.fun in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Treasure It, its affiliates, licensors, service providers, officers, directors, employees, agents, contractors, successors, assigns, and third parties (collectively, the "Treasure It Parties") from and against any third-party losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of: (a) your use of or inability to use the Site or services, including any items or services exchanged between users through the Site; (b) any User Content posted, uploaded, or submitted by you; (c) your violation of any terms of this Agreement; (d) your violation of any rights of a third party, including any intellectual property, privacy, or publicity rights; or (e) your violation of any applicable laws, rules or regulations.

You agree to promptly notify the Treasure It Parties of any third-party claims arising out of or related to your use of the Site, to cooperate fully with the Treasure It Parties in defending such claims, and pay all fees, costs and expenses associated with defending such claims (including, but not limited to, attorneys' fees). Treasure It reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Treasure It in asserting any available defenses.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. TREASURE IT AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

TREASURE IT and the TREASURE it parties MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OR CONDITION OF ANY KIND. TREASURE IT AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREASURE IT AND/OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF TREASURE IT OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IN NO EVENT SHALL TREASURE IT'S AGGREGATE LIABILITY TO YOU, FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EXCEED THE GREATER OF: (I) ONE HUNDRED DOLLARS ($100); OR (II) THE TOTAL AMOUNTS PAID BY YOU TO TREASURE IT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

TREASURE IT CANNOT AND DOES NOT GUARANTEE OR WARRANT THAT FILES AVAILABLE FOR DOWNLOADING FROM THE INTERNET OR THE SERVICES WILL BE FREE OF VIRUSES OR OTHER DESTRUCTIVE CODE. YOU ARE RESPONSIBLE FOR IMPLEMENTING SUFFICIENT PROCEDURES AND CHECKPOINTS TO SATISFY YOUR PARTICULAR REQUIREMENTS FOR ANTI-VIRUS PROTECTION AND ACCURACY OF DATA INPUT AND OUTPUT, AND FOR MAINTAINING A MEANS EXTERNAL TO OUR SITE FOR ANY RECONSTRUCTION OF ANY LOST DATA. TO THE FULLEST EXTENT PROVIDED BY LAW, TREASURE IT WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE, OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT OR ON ANY SITES LINKED TO IT.

WITHOUT LIMITING THE FOREGOING, NEITHER TREASURE IT NOR ANYONE ASSOCIATED WITH TREASURE IT REPRESENTS OR WARRANTS THAT THE SERVICES, PRODUCTS, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

Arbitration

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND TREASURE IT TO ARBITRATE CERTAIN DISPUTES AND CLAIMS AND LIMITS THE MANNER IN WHICH WE CAN SEEK RELIEF FROM EACH OTHER. ARBITRATION PRECLUDES YOU AND TREASURE IT FROM SUING IN COURT OR HAVING A JURY TRIAL. YOU AND TREASURE IT AGREE THAT ARBITRATION WILL BE SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ARBITRATION, CLASS ACTION, OR ANY OTHER KIND OF REPRESENTATIVE PROCEEDING. YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION PROVISION AS DESCRIBED BELOW.

Before initiating arbitration, you and Treasure It agree to first attempt to resolve any dispute informally in an order to reduce costs for both parties. You and Treasure It will make a good-faith effort to negotiate the resolution of any Claim for at least sixty (60) days ("Informal Resolution"). This 60-day period starts on the day you or Treasure It receive a written notice of a claim from the other party (a "Notice of Claim") in accordance with this Agreement. You will send any Notice of Claim to Treasure It to: ben@treasureit.fun. You must personally sign the Notice of Claim. Treasure It will send any Notice of Claim to your registered email address and ATTN: NOTICE OF CLAIM to any billing address and/or shipping address you have provided us. This informal dispute resolution process is a condition precedent to initiating arbitration, and neither party may commence arbitration before the 60-day period has elapsed.

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, in accordance with the AAA's Consumer Arbitration Rules then in effect, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

If the Claim is not resolved within the Informal Resolution period of sixty (60) days (which period can be extended by agreement of the parties), you or Treasure It may start an arbitration in accordance with this Agreement (or, at the option of either party, commence a proceeding in small claims court).

Any claim arising out of or related to these Terms or the use of our Services must be filed within two (2) years after such claim arose, to the fullest extent permitted by applicable law; otherwise, the claim is permanently barred, which means that you and Treasure It will not have the right to assert the claim. Notwithstanding the foregoing, this shortened limitations period does not apply where a longer period is required by applicable law and cannot be waived by contract.

You have the right to opt out of this binding arbitration provision within thirty (30) days of the date you first accept these Terms by sending written notice to Treasure It at ben@treasureit.fun. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, all disputes will be resolved exclusively in the state or federal courts located in New York and you and Treasure It each consent to personal jurisdiction in those courts.

Class Action Waiver

ANY ARBITRATION UNDER THESE TERMS AND CONDITIONS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS/REPRESENTATIVE/COLLECTIVE ACTIONS ARE NOT PERMITTED. EXCEPT FOR CERTAIN TYPES OF DISPUTES THAT MAY BE BROUGHT IN COURT AS DESCRIBED ABOVE, THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. FURTHER, UNLESS BOTH YOU AND TREASURE IT AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Termination/Access Restriction & General Provisions

Treasure It reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, with or without cause. Where practicable and except in cases of violation of these Terms, Treasure It will provide reasonable notice prior to termination. Treasure It reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, with or without cause. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Treasure It as a result of this agreement or use of the Site. Treasure It's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Treasure It's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Treasure It with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings.

It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms
